This is an English translation provided for reference. If there is any difference between this translation and the Japanese version, the Japanese version prevails.

These Terms of Use (the “Terms”) set out the conditions for using “hibi” (the “App”), a journal app provided by BMTX (“we,” “us,” or “our”). You shall use the App in accordance with these Terms.

Article 1 (Scope and Agreement to These Terms)

  1. These Terms apply to all relationships between you and us relating to the use of the App.
  2. You are deemed to have agreed to these Terms when you download the App or start using it.
  3. If we separately set out guidelines, notes, or the like regarding the use of the App, they also form part of these Terms.
  4. Your personal information and data are handled in accordance with our separate “Privacy Policy” (please read it together with these Terms).

Article 2 (Features of the App and Underlying Premise)

The App has no server that stores the content you record in your journal, such as the text, photos, videos, location information, tags, and moods of your entries. This content is stored only on your device and in your own Google Drive that you have connected yourself.

We have no means of accessing the text, photos, or videos of your journal.

Please read these Terms with this premise in mind. Details of how the App handles information are set out in the Privacy Policy.

Article 3 (Accounts and Conditions for Using Google Sign-In)

  1. The App does not require you to register for an account of our own in order to keep your journal.
  2. If you use certain features of the App (backing up to and restoring from your own Google Drive), you may sign in with your Google account (“Google sign-in”).
  3. If you use Google sign-in, the terms of service and privacy policy set by Google apply separately. You shall manage your Google account at your own responsibility.
  4. You are responsible for properly managing the credentials of your Google account. We are not liable for any damage arising from unauthorized use of your Google account.

Article 4 (Your Responsibilities; Data Management and Backup)

  1. In principle, the content of the journal you record in the App is stored on your device. Data on your device may be lost due to failure, loss, or reset of the device, uninstallation of the App, OS updates, and the like.
  2. You are responsible for preserving your own data. We provide a feature for backing up to Google Drive as a means of backing up your data, but whether you use it is up to you.
  3. We recommend that you do not use the App as the only place where your records are kept, and that you make your own backups as needed (for example, by using the Google Drive backup feature or the data export feature).
  4. We are not liable for any loss or corruption of data on your device or in your own Google Drive.

Article 5 (Prohibited Conduct)

When using the App, you shall not engage in any of the following conduct.

  1. Conduct that violates laws and regulations or public order and morals
  2. Conduct that infringes the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of us or any third party
  3. Decompiling, disassembling, or reverse engineering the software of the App (except to the extent permitted by law)
  4. Intentionally exploiting bugs in the App, or placing an excessive load on the App
  5. Modifying, copying, or redistributing the App in a manner we do not intend
  6. Any other conduct that we reasonably determine to be inappropriate

* We do not view or monitor the content of the journal you record in the App. The prohibitions in this Article mainly concern how the software of the App itself is used.

Article 6 (Rights to User Content)

  1. Copyright and all other rights in the text, photos, videos, and other content of the journal you record in the App (“User Content”) belong to you or the legitimate rights holder.
  2. We have no means of storing or collecting User Content. Accordingly, we do not use or publish User Content, or provide it to any third party.
  3. You warrant that you hold legitimate rights to your User Content or have obtained the necessary permissions. You shall resolve, at your own responsibility and expense, any dispute arising from recording content that infringes the rights of a third party, and we are not liable for such disputes.

Article 7 (Intellectual Property Rights)

  1. The intellectual property rights in the App and in all software, designs, logos, text, images, and other content that we provide in connection with the App (excluding User Content) belong to us or the legitimate rights holder.
  2. You shall not use any of these (including copying, reposting, modifying, or redistributing them) beyond the scope of using the App under these Terms.

Article 8 (Disclaimers and No Warranty)

  1. The App is provided “as is.” We do not warrant that the App is fit for any particular purpose, that it is free of errors or bugs, or that it can be used without interruption.
  2. We are not liable for any damage you suffer from using or being unable to use the App (including loss or corruption of data, lost opportunities, and the like).
  3. The backup and restore features of the App depend on the Google Drive service provided by Google. Backup or restore may not be possible due to changes in the specifications of, outages of, or discontinuation of Google Drive, changes in the status of your Google account, and the like. We are not liable for any damage resulting from these.
  4. The App is currently provided free of charge. In view of the fact that it is provided free of charge, and notwithstanding the preceding paragraphs, our liability is limited to the extent permitted by law.
  5. If you are a consumer under the Consumer Contract Act, and any provision of these Terms concerning our exemption from liability (including Article 3, Paragraph 4; Article 4, Paragraph 4; each paragraph of this Article; Article 9, Paragraph 5; and any other provision concerning exemption from liability) is contrary to that Act or other mandatory laws, such provision concerning exemption from liability shall not apply to the extent that such mandatory laws apply. The same applies to cases caused by our willful misconduct or gross negligence.
  6. Even where we are liable to you for damages under the preceding paragraph, the amount of compensation we pay shall not exceed the amount of fees for the App that we actually received from you in the month in which the damage occurred.

Article 9 (Changes, Suspension, and Termination of the Service)

  1. We may change, add to, or remove all or part of the content of the App without prior notice to you.
  2. We may temporarily suspend the provision of the App for maintenance, system failures, or other unavoidable reasons.
  3. We may end the provision of the App by giving notice on this page or in the App a reasonable period in advance. However, this does not apply in cases of urgent and unavoidable necessity.
  4. Even if the provision of the App ends, the data stored on your device and in your own Google Drive remains under your control. We recommend that you back up and export your data yourself as needed in preparation for the end of the service.
  5. We are not liable for any damage you suffer from any change, suspension, or termination of the App under this Article.

Article 10 (Changes to These Terms)

  1. We may change these Terms as necessary.
  2. When we change these Terms, we will post the revised Terms on this page or in the App. When we make an important change, we will notify you in a clear manner in the App or on this page.
  3. The revised Terms take effect when they are posted on this page. If you continue to use the App after such posting, you are deemed to have agreed to the revised Terms.

Article 11 (Governing Law and Jurisdiction)

  1. The interpretation and application of these Terms are governed by the laws of Japan.
  2. If any dispute arises between you and us in connection with the App or these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance by agreement.
